Our terms

1 – GOTA DAGUA SURF CAMPS & COLIVING

1.1 GENERAL BOOKING

1.1.1 The surf camp & coliving is managed by Gota Dagua Surf Camps and School , hereafter referred to as “Organiser”.
1.1.2 To validate your inscription and to confirm your booking, the total amount or advanced deposit payment of the required services must be paid.
1.1.3 The booking will be considered as valid when the required amount has been paid via one of our payment option through our booking platform and you have received a confirmation email with the booking details.
1.1.4 All prices are in euros, and per person, per week, unless stated otherwise. Upon making your booking, the price of your holiday will not normally be subject to change, however we reserve the right to increase or decrease prices due to variations in service charges, offers, insurance/security levels or exchange rates.
1.1.5 Once a booking has been made, discounts cannot be applied retrospectively.
1.1.6 A minimum deposit of 30% is required to confirm your booking. Should the required amount not be made within 48h from the booking’s creation time or the booking will expire.

1.2 PAYMENT & PRICES

1.2.1 All bookings are confirmed and valid in accordance to section 1.1.3.
1.2.2 Any bookings created 60 days or less before the arrival date is required to pay 100% of the total amount to be considered confirmed and valid.
1.2.3 Any bookings created 60 days or more before the arrival date is required to pay the deposit of 30%, as mentioned in section 1.1.6, to be considered as confirmed and valid.
1.2.4 All bookings with a valid and confirmed deposit will receive an automatic email 7 days before the last payment deadline of 60 days before arrival date, as mentioned in section 1.2.2
1.2.5 Any bookings who does not follow the payment deadlines, we reserve the right to treat the booking as a cancellation. In that case please refer to section 1.1.6.
1.2.6 Group bookings:
1.2.6.1 All group bookings need to be inquired through our email: [email protected]
1.2.6.2 Group bookings are considered as ‘groups’ over or equal to 10 people.
1.2.6.3 All Group bookings are required to pay 30% of the total amount to be considered as confirmed and valid. The group booking deposit is non-refundable.
1.2.6.4 All Group bookings are required to pay the last 70% of the total amount 30 days before arrival date. Non-refundable.

1.3 CONDITIONS

1.3.1 The participants’ minimum age is 18 years old as a solo traveler.
1.3.2 The Organiser reserves the right to make modifications, but only if these modifications do not change the essential services or due to unexpected and uncontrollable situations.
1.3.3 Images of your program are only used for publicity or promotional purposes as web sites, flyers, brochures.
1.3.4 Customers must be physically fit and capable of swimming. The client confirms that from a medical point of view, there is nothing that prevents him/her from going surfing or bodyboarding. We require that you communicate any relevant medical aspects: allergies, disabilities, medical incapacities.
1.3.5 Each customer is responsible for the equipment provided by the Organiser, during its use and accepts the responsibility to replace it in case of loss or serious damage by inappropriate use of it. The customer has to pay the lost or damaged equipment which automatically becomes the customer’s property.
1.3.6 The excursions and trips we offer are not included in the total camp price. They depend on a minimum number of participants and availability. These reasons can lead to a cancellation of the previous.

1.4 CANCELATION & REFUND POLICY

1.4.1 All booking cancellations are required to be formally written and sent to [email protected]
1.4.2 All bookings that are canceled less than 30 days before the arrival date are non-refundable.
1.4.3 All bookings can benefit from a free cancellation if the booker cancels within 7 days after receiving the booking confirmation form with exception of bookings made less than 61 days before arrival dates.
1.4.4 All bookings can benefit from a free rebooking opportunity valid once per booking if informed more than 14 days before the arrival date. Rebooking dates cannot exceed 365 days from the cancellation date.
1.4.5 All bookings which does not fit the criterias in section 1.4.2/1.4.3/1.4.4 Please refer to the refund distribution amount below:
1.4.5.1 From 61 days or more to the arrival date: 75% (you will be charged 30 % of the total booking amount).
1.4.5.2 60 days or less to the arrival date: 50% (you will be charged 50 % of the total booking amount).
1.4.5.3 Under 30 days to the arrival date: 0% (you will be charged 100 % of the total booking amount).
1.4.6 For any cancellations during the program, read the following.
1.4.6.1 The Organiser will not refund any of the program’s activities should you miss them during the program or sustained any injuries during the program.
1.4.6.2 The Organiser’s program schedule can change at any time and the students will be informed max 12h before through the program notification board and group chat.
1.4.6.3 The Organiser is allowed to cancel, without refund, any surf lesson or activity during the program should there be a lack of waves, extreme/dangerous conditions or any other external factors.

1.5 DISCOUNTS

1.5.1 Discounts are valid for a maximum of 1 booking per week, any extra days are charged according to the normal season prices.
1.5.2 Discounts can only be applied or claimed should the creation date of the booking be within the discount valid time frame.
1.5.3 Discount are non-refundable. A booking may still be cancelled in accordance with section 1.4.

1.6 RESPONSIBILITIES

1.6.1 The Organiser does note accept any responsibilities or any refunds in the following circumstances:
1.6.1.1 When the client/booker is responsible for the incorrect delivery of the services.
1.6.1.2 When the defective services are due to third parties or they occur in an unpredictable manner.
1.6.1.3 When the services cannot be provided, due to conditions beyond the control of the Organiser. These are unusual and unpredictable conditions which could result in unexpected consequences such as natural disasters, political and social circumstances.
1.6.1.4 When the incorrect delivery of the services are caused within the Organiser’s responsibility, even though all the diligence is taken, they still could neither be predicted nor prevented.
1.6.1.5 When any event occuring before and after the program hours, the Organiser do not hold any responsibility.
1.6.1.6 Clients have to listen to the instructions of our staff and to follow the Organiser’s regulations. In case of not doing so and behaving irresponsibly, the Organiserwill take the necessary measures, prior notification, such as the exclusion of the courses/camp.

1.7 PARTNERS

1.7.1 A travel agency/partner that is representing the Organiser is advised to maintain the same prices as we are offering on our website, unless agreed differently by contract.
1.7.2 Should a partner/agency charge less than the price list given by the Organiser. Their commission percentage will nonetheless be based from the the price list given by the Organiser.
1.7.3 The Organiser can not be held responsible for overcharging in any way by a third party.
1.7.4 Once a booking has been confirmed by the guest through the Organiser’s website, it is not possible to transfer this booking over to an agency – even if they offer a cheaper price compared to our website(see section 1.7.3). In such cases we keep the right to reject the new booking of the third party at any time.

1.8 INSURANCE

1.8.1 For medical assistance during your stay, each client needs to have:
1.8.1.1 Medical card and insurance.
1.8.1.2 Contract of travel insurance

1.9 LIABILITY & COMPLAINTS

1.9.1 Liability: the Organiser accepts responsibility for ensuring the program you book is as described in the brochure and the services offered reach a reasonable standard.
1.9.2 If any activity/accomodation is not up to the standard advertised, the Organiser will pay you the appropriate compensation should it has affected your enjoyment during your program.
1.9.3 Complaints: If you wish to make a complaint or claim the program. you must report it to the relevant supplier of the problem in question and to the Organiser’s representatives, thereby giving them the opportunity to remedy the problem.
1.9.4 The Organiser ecannot accept any liability whatsoever if the Organiser is not informed immediately, of any problem during the program. Complaints not resolved to the fullest should be made in writing within 28 days after your program booking end date.

1.10 MEDIA RELEASE CLAUSE

1.10.1 The Organiser’s Media Staff may take photographs, videos, or other recordings of the program’s activities and its participants. By participating in the program, participants and their parents or legal guardians consent to the use of their image, likeness, or voice in any promotional materials related to the Organiser, including but not limited to brochures, websites, social media, and advertising.
1.10.2 Participants and their parents or legal guardians understand that the Organiser will not sell or license these photographs, videos, or other recordings to third parties without their consent. If participants or their parents or legal guardians revoke their consent, the Organiser will cease using their image, likeness, or voice in future promotional materials. However, the Organiser may continue to use the photographs, videos, or other recordings that were taken prior to the revocation of consent.

1.11 COUNTRY OF JURISDICTION:

By paying the services offered by the Organiser, you automatically accept the previous terms and conditions in regards to the the Organiser’s service location.

2 – GOTA DAGUA SURFSCHOOL

2.1 GENERAL BOOKING

2.1.1 The surf school is managed by Gota Dagua Surf Camps and School , hereafter referred to as “Organiser”.
2.1.2 To validate your inscription and to confirm your booking, the payment of the required services must be paid.
2.1.3 The booking will be considered as valid when the required amount has been paid via one of our payment option through our booking platform and you have received a confirmation email with the booking details.
2.1.4 All prices are in euros, and per person, unless stated otherwise. Upon making your booking, the price of your surf lesson will not normally be subject to change, however we reserve the right to increase or decrease prices due to variations in service charges, offers, insurance/security levels or exchange rates.
2.1.5 Once a booking has been made, discounts cannot be applied retrospectively.

2.2 PAYMENT & PRICES

2.2.1 All website bookings are considered as confirmed and valid if the booking is created and paid at least 12 hours before the surf lesson starting time.
2.2.2 All bookings created less than 12 hours before lesson starting time have to be inquired and created on site at our surf school or requested by email, phone contact.
2.2.3 All surf packages & vouchers have a 1 year expiration date from the booking creation date.
2.2.4 All Surf lesson packages & vouchers cannot be returned or refunded and cannot be redeemed for cash or credit.
2.2.5 All Surf lesson packages & vouchers cannot be redeemed on products from the Organiser.
2.2.6 All Surf lesson packages & vouchers are exclusive for the person that booked (individual).
2.2.7 All Surf lesson packages & vouchers have to booked under the name of the surfer (student).
2.2.8 No-shows of any booked surf lesson will count as a lesson and be debited from your surf package or voucher.
2.2.9 Group Bookings:
2.2.9.1 Group bookings are bookings made by a single person/agency for at least 10 people.
2.2.9.2 Group bookings have to be confirmed by email and sent to [email protected].
2.2.9.2 The full Payment of the group booking has to be made in full no less than 14 days before the lesson booking date.

2.3 CONDITIONS

2.3.1 Customers must be physically fit and capable of swimming. The client confirms that from a medical point of view, there is nothing that prevents him/her from going surfing or bodyboarding. We require that you communicate any relevant medical aspects: allergies, disabilities, medical incapacities.
2.3.2 Each customer is responsible for the Organisers equipment during its use and accepts the responsibility to replace it in case of loss or serious damage by inappropriate use of it. The customer has to pay the lost or damaged equipment which automatically becomes the customer’s property.
2.3.3 The return of leased equipment before the end of the lease period will not grant the Lessee a right to any reduction to the agreed price (see section 2.5.8). Not returning the equipment within the lease period will incur the payment of a € 100,00 penalty each day of delay, regardless of any legal actions the Lessor may take.
2.3.4 Should the leased equipment be stolen from Lessee he or she must file a criminal complaint of such fact to the police authorities. As the lessee is responsible for the rented equipment.
2.3.5 The Lessee shall be responsible for any damages done to the leased equipment. Should there be any damage, the lesse needs to compensate the Lessor with the amount that is necessary for the full recovery of the equipment.
2.3.6 The equipment lease does not include any indemnity or personal accidents insurance and, therefore, any damages done to the lessee himself or to third parties will be the lessee´s exclusive responsability.
3.7 If the leased equipment is stolen from the lessee he must make a complaint to the police authorities and shall be responsible to the lessor for the payment of compensation of € 300,00 for each board, € 100,00 for each wetsuit and € 50.00 for each pair of flippers.

2.4 DISCOUNTS & VOUCHERS

2.4.1 Discounts and vouchers are valid per person, per booking. Any extra lesson will be charged according to the current season prices.
2.4.2 Discounts and vouchers can only be applied or claimed should the creation date of the booking be within the discount valid time frame. As per section 2.2.3.
2.4.3 Discounts are non-refundable. A booking may still be cancelled in accordance with section 2.2.5.

2.5 CANCELATION & REFUND POLICY

2.5.1 All lessons/rentals cancellations have to be made more than 24 hours before the lesson start time/ day of the lesson/rental, respectively, in order to receive a refund/ credit. Cancellations shall be made by email sent to [email protected]. Should the email be sent less than 24 hours before the lesson/rental starting time, you will not be eligible for any refund or credit.
2.5.2 All other lessons/rentals cancellations or no-shows will not receive a refund or credit.
2.5.3 Surf lessons/rentals will not be cancelled due to rain, but maybe cancelled if the conditions are deemed to be dangerous, or if the Organiser does not get enough bookings to run the lesson.
2.5.4 Should a booking be cancelled from the Organiser, you will be contacted by the Organiser if, for some reason, the lesson/rental is postponed or cancelled. Should this happen, you will be fully refunded or given a credit equivalent to the amount of the cancelled booking.
2.5.5 The participant need to arrive 30 minutes before the start of the surf lesson, if the participant is late and the lesson already started, the lesson will be charged and seen as a no-show.
2.5.6 The Surf Lessons schedule is done by the the Organiser and is not flexible to the student’s availability. It is done according to the best conditions for maximum safety and ensures an enjoyable experience.
2.5.7 Refunds take between 5-10 working days according to the payment method .
2.5.8 Rentals for which the lessee wishes to give back the rented material earlier than the rentals end time are not entitled to any refund or credit.

2.6 RESPONSIBILITIES

3 – GOTA DAGUA JUNIOR SURF CAMP & KIDS ACTIVITIES CLUB

3.1 GENERAL BOOKING

3.1.1 The Junior Surf Camp and Kids Activities Club is managed by Gota Dagua Surf Camps and School , hereafter referred to as “Organiser”.
3.1.2 To validate your inscription and to confirm your booking, the total amount or advanced deposit payment of the required services must be paid.
3.1.3 The booking will be considered as valid when the required amount has been paid via one of our payment option through our booking platform and you have received a confirmation email with the booking details.
3.1.4 All prices are in euros, and per person, per week, unless stated otherwise. Upon making your booking, the price of your holiday will not normally be subject to change, however we reserve the right to increase or decrease prices due to variations in service charges, offers, insurance/security levels or exchange rates.
3.1.5 Once a booking has been made, discounts cannot be applied retrospectively.
3.1.6 A minimum deposit of 30% is required to confirm your booking. Should the required amount not be made within 48h from the booking’s creation time or the booking will expire.

3.2.5 Any bookings who does not follow the payment deadlines, we reserve the right to treat the booking as a cancellation. In that case please refer section 7.

3.3 CONDITIONS

3.3.1 The participants’ minimum age for the Junior Surf Camp program is 12 years old and up to a maximum of 17 years old.
3.3.2 The participants’ minimum age for the Kids Activities Club program is 6 years old and up to a maximum of 17 years old.
3.3.3 The Organiser reserves the right to make modifications, but only if these modifications do not change the essential services or due to unexpected and uncontrollable situations.
3.3.4 Images of your stay are only used for publicity or promotional purposes as web sites, flyers, brochures.
3.3.5 Participants must be physically fit and capable of swimming. The parents confirm that from a medical point of view, their child has nothing that prevents him/her from going surfing or bodyboarding. We require that you communicate any relevant medical aspects: allergies, disabilities, medical incapacities.
3.3.6 Participants are expected to behave in a respectful and appropriate manner towards other participants, staff, and the property of the Organiser. Any participant who behaves inappropriately or disruptively, as determined by the Organiser’s staff, may be dismissed from the program. Disruptive behavior includes, but is not limited to, bullying, harassment, vandalism, theft, drug or alcohol use, and any behavior that endangers the safety of themselves or others.
3.3.7 If a participant is dismissed from the progam for disruptive behavior, their parents or legal guardians will be notified immediately. The Organiser reserves the right to expel a participant from the program at any time, without refund or compensation, if their behavior poses a risk to the safety or well-being of other participants or staff. Any costs thereafter expulsion, are to be handled by the parents or legal guardians.
3.3.8 Participamnts and their parents or legal guardians are responsible for any damage caused by their participant to the property of the Organiser. The Organiser reserves the right to charge participants and their parents or legal guardians for any repairs or replacement costs.
3.3.8 By signing the registration form or participating in the program, participants and their parents or legal guardians acknowledge that they have read and understand these terms and conditions for bad behavior and agree to abide by them. Participants and their parents or legal guardians also acknowledge that they are responsible for the behavior of the participant during the program and accept the consequences of any violation of these terms and conditions.

3.4 DISCOUNTS/VOUCHERS

3.11.1 I authorize my son /daughter to stay in the facilities of the Organiser, to be a part of the activities organized by the Organiser, in accordance with the characteristics and general regulations of said activity of which I have been duly informed during the registration process.
3.11.2 Participating in the activity implies acceptance of the conditions of the same, as well as the guidelines set by the coordinators and monitors in everything that refers to the smooth running of the group or to the conduct of the group.
3.11.3 I also declare to know and accept the conditions and activities that take place in this camp and expressly waive to take any legal action against those responsible for this, or against the Organiser, under circumstances that are attributable to disobedience or individual negligence of the participant.
3.11.4 I authorize the person in charge or the health institution where the participant is at the time, to take the necessary decisions in case of medical emergency in the impossibility of contacting parents or legal representative.

3.12 COUNTRY OF JURISDICTION

By paying the services offered by the Organiser, you automatically accept the previous terms and conditions in regards to the the Organiser’s service location.
